Terms of Use

Terms of Use

The Foundation for Democracy & Justice (“the Foundation”) owns, operates and maintains the following website: fdjca.org hereinafter referred to as “Web site.” The Web site, all of the pages and screens on the Web site, including the content contained therein and any accompanying documents, are owned and controlled or licensed by the Foundation, except as otherwise expressly stated, and are protected by U.S. copyright and other intellectual property laws and treaties.

License Agreement

The Foundation grants you a nonexclusive, non-assignable, nontransferable license to access and use the Web site and content contained therein for internal business purposes only.

The Foundation reserves the right to revoke the license conferred herein at any time without warning and without cause.

Limited Warranty and Disclaimer

The Web site is offered on an “AS IS” basis. The Foundation makes no warranty or representation, either express or implied, with respect to the Web site or the content contained therein, including their quality, performance, merchantability or fitness for a particular purpose. The Foundation does not warrant that the Web site is error or virus free and makes no representation or warranty as to the speed or performance of the Web site.

The information contained on the Web site is being provided by the Foundation as a service to the general community. Although every effort is made to ensure the accuracy and completeness of this information, the Foundation and its employees, contributors and reviewers cannot be responsible for any errors or omissions, nor for any governmental agency’s interpretations, applications and changes of policies described herein.

The Web site is designed to provide accurate and authoritative information in a highly summarized manner concerning the subject matter covered. They are provided with the understanding that the Foundation and others associated with it are not engaged in rendering legal, technical or other professional advice or service. If legal and other expert assistance is required, the services of competent professionals should be sought.

Limitation of Liability

In no event will the Foundation be liable to you whether in contract or in tort or under any other legal theory (including, without limitation, strict liability and negligence) for lost profits or revenues, loss or interruption of use, or any other economic loss, or for any indirect, special, incidental, consequential or similar damages, arising out of or in connection with the performance or non-performance of the Web site and this Agreement, or for any claim made against any user, including without limitation, a member or subscriber, by any other party.

U.S. Government Restricted Rights

In addition to the restrictions on use provided above, the materials on the Web site are provided with “RESTRICTED RIGHTS.” Use, duplication or disclosure by any federal, state or local government or authority is subject to further restrictions as set forth in applicable laws and regulations. Use of the materials by such government or authority constitutes acknowledgment of the Foundation’s proprietary rights in them.

Permission

Unless expressly stated otherwise, all of the content and graphics contained on the Web site are protected by U.S. copyright and international treaties and may not be copied, reproduced, republished or distributed without the express permission of the Foundation. Copying, displaying, distributing, transferring, linking to, reproducing, licensing, altering, creating derivative works of or republishing all or any portion of the Web site for any commercial or public purpose without the Foundation’s permission is strictly prohibited. The Foundation does not allow reproduction of the content and graphics contained on the Web site, unless the content is expressly labeled with a grant of permission to reproduce and the content is presented in its original state with reference to the Foundation.

U.S. Digital Millennium Copyright Act Notice

If you believe that your work has been copied in any way without your permission, please provide the following information to our agent to receive Notification of Claimed Copyright Infringement identified below. Your notice must contain the following:

  • Your electronic or physical signature;
  • A description of the work you claim has been infringed;
  • Identification of the work you claim infringes the copyrighted work and a description of where it is located on the Foundation website;
  • Your address, telephone number and email address;
  • A statement by you that you have a good faith belief that the infringing use is not authorized by the copyright owner, the copyright owner’s agent or by law; and
  • A statement by you, under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Trademarks

Trademarks of the Foundation for Democracy and Justice, including but not limited to the Foundation, may not be used without prior, written permission.

Policy Guidelines for Editorial Content

The Foundation is committed to a policy of editorial neutrality. Although the content on the Web site contain information about state and federal laws and regulations, the content is not intended to serve as legal advice.

Our Transmissions

Any material, information or idea you transmit to or post on the Web site by any means will be treated as non-confidential and nonproprietary, and may be disseminated or used by the Foundation or its affiliates for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products. The Foundation may monitor, record or otherwise capture and maintain a record of your site session for quality control or other purposes. Notwithstanding the foregoing, all personal data provided to or captured by the Foundation online will be handled in accordance with the Foundation’s Privacy Policy. You are prohibited from posting or transmitting to or from the Web site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material, or any other material that could give rise to any civil or criminal liability under the law.

Content from External Sources and Links to External Sites

The Web site may contain content from and links to external Web site controlled or offered by third parties unaffiliated with the Foundation. Content from external sources will be identified when the information is not generated by the Foundation. Links to external sites do not constitute as an endorsement of the linked content, and the Foundation does not guarantee the accuracy of the linked content.

The Foundation hereby disclaims liability for the content, products, privacy policies or security of a third party’s Web site. Any advice, opinions or recommendations provided by a linked Web site are those of the third party and not of the Foundation. Participation in any linked Web site, including payment for and the delivery of goods or services is based solely on the agreement, if any, between you and the third party.

Corrections and Clarifications

The Foundation is committed to correcting any factual errors or errors in interpretation. Editorial staff will address any errors brought to their attention and make appropriate corrections in a timely manner.

To reproduce the Foundation editorial content for corporate distribution or educational use, please contact smadanat@fdjca.org and specify the title of the article and the number of copies you would like to distribute.

Governing Law

You agree that any claim relating to the Site and the materials contained on the Site and related to your access and use of the Site will be governed by the laws of the state of California without regard to California’s conflicts of laws principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Sacramento County, California.

Severability

If any one or more of the provisions contained in this Agreement is, for any reason, held to be invalid, illegal or unenforceable in any respect, then to the maximum extent permitted by law, the invalidity, illegality or unenforceability will not affect any other provision of this Agreement.
